After a person has earned the right to drive in California, he/she must obey the rules of the road in order to maintain a clear driving record. Every time a person fails to obey the rules of the road, or violates a traffic law, he/she will be issued a citation by law enforcement. These citations will lead to the accumulation of points on the person’s driving record. Usually, a traffic violation is worth 1-2 points, DUI is 2 points, and causing an accident is 1 point. Once a person has too many points on his/her driving record, he/she may be classified as a negligent driver, which may lead to the suspension of his/her driving privileges.

In California, drivers may be deemed a Negligent Operator and have their driving privileges suspended for six months if they receive:

  • 4 points within 12 months
  • 6 points within 24 months
  • 8 points within 36 months

After a person is classified as a negligent driver, he/she will have to attend a hearing at the California Department of Motor Vehicles. At the hearing, the person’s driving record will be reviewed, and his/her points will be tallied by a DMV representative. If the DMV representative finds that action must be taken against the person, his/her driver’s license may be temporarily suspended. The DMV representative will make the final decision as to which course of action will be taken after all evidence has been carefully considered.
